EMPLOYMENT LEGAL ADVICE HOTLINE SERVICE AGREEMENT

PARTIES

This Service Contract Agreement (hereinafter referred to as the “Agreement”) is entered into by the signing of this Agreement by the Customer (the “Effective Date”), by and between HR Global Solutions, (hereinafter referred to as the “Service Provider”) and the signatory of this agreement, (hereinafter referred to as the “Customer”) (collectively referred to as the “Parties”).

PARTIES TO THE LEGAL ADVICE HOTLINE SERVICE AGREEMENT

This Service Contract Agreement (hereinafter referred to as the “Agreement”) is entered into by the signing of this Agreement by the Customer (the “Effective Date”), by and between HR Global Solutions, (hereinafter referred to as the “Service Provider”) and the signatory of this agreement, (hereinafter referred to as the “Customer”) (collectively referred to as the “Parties”).

SERVICE PROVIDED & PRICE FOR THE HR PHONE ASSIST

  • During the period of this Agreement, the Service Provider shall have the responsibility to provide HR and Safety phone advice for your business (hereinafter referred to as “Services”)

  • HR Phone Assist is designed to provide employers with first level phone support relating to  human resources, workplace relations and workplace safety matters.

  • Customer is entitled to receive phone advice during the operational hours and days stipulated in this agreement.

  • HR Phone Assist is provided for 20 minutes per issue and call unless otherwise agreed to by the Service Provider

  • (Price: $305.00 per calendar month plus GST or $3,660.00 annually plus GST)

SERVICE PROVIDED & PRICE FOR THE EMPLOYMENT LEGAL ADVICE HOTLINE

  • During the period of this Agreement, the Service Provider shall have the responsibility to provide general comment only phone advice for your business (hereinafter referred to as “Services”)

  • Employment Legal Advice Hotline is designed to provide employers with first level phone support relating to human resources, workplace relations and workplace safety matters.

  • Customer is entitled to receive phone advice during the operational hours and days stipulated in this agreement.

  • Employment Legal Advice Hotline is provided for 15 minutes per issue and call unless otherwise agreed to by the Service Provider

(Price: $275.00 per calendar month plus GST or $3,300 annually plus GST)

LIST OF SERVICES PROVIDED AND PRICE FOR HR ONLINE SOLUTIONS

  • During the period of this Agreement, the Service Provider shall have the responsibility to provide direct access the fully integrated HR online solutions for your business (hereinafter referred to as “Services”)

  • HR Online Solutions is designed to provide employers with HR policies, procedures, onboarding, paper forms and PDF files relating to  human resources, workplace relations and workplace safety matters.

  • Customer is entitled to receive updates to the HR policies, procedures, onboarding, paper forms and PDF files at not cost during the terms of this Agreement.

  • During the period of this Agreement, the Service Provider shall have the responsibility to perform and provide the following services (hereinafter referred to as “Services”):

HOURS OF OPERATION

Access to HR Online Solutions is assisted by calling Phone Assist (1300 46 47 47). The Phone Assist is supported during the following days and operational hours:

  • Monday-Friday 7am–7pm

  • National Public holidays are excluded from this service being provided

INVOICES

The Parties agree that the invoiced amounts must be paid within 5 days after the Client receives the invoice.

TERM OF AGREEMENT

  • This Agreement shall be effective on the date of signing this Agreement (hereinafter referred to as the “Effective Date”) and will end on 12 months after the signing of this Agreement.

  • At the end of the term of the Agreement, it will automatically renew for a new term, subject to the terms and conditions reflected in the Termination clause of this Agreement

TERMINATION

This Agreement may be terminated in the event that any of the following occurs:

  1. Immediately in the event that one of the Parties breaches this Agreement.

  2. At any given time by providing written notice to the other party 21 days prior to terminating the Agreement.

RELATIONSHIP OF THE PARTIES

The Parties agree that this is a non-exclusive agreement and that the Parties are regarded as independent contractors.

AMENDMENTS

  • The Parties agree that any amendments made to this Agreement must be in writing, where they must be signed by both Parties to this Agreement.

  • Accordingly, any amendments made by the Parties will be applied to this Agreement.

ASSIGNMENT

The Parties are not entitled to assign the responsibilities that they have under this Agreement to anyone else, unless both Parties agree to the assignment and provide such agreement in writing.

ENTIRE AGREEMENT

This Agreement contains the entire agreement and understanding among the Parties to it with respect to its subject matter, and supersedes all prior agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to its subject matter. The express terms of the Agreement control and supersede any course of performance and/or usage of the trade inconsistent with any of its terms.

SEVERABILITY

In the event that any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, then the remaining provisions will remain in force in accordance with the Parties’ intention.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Australia.

ALTERNATIVE DISPUTE RESOLUTION

Any dispute or difference whatsoever arising out of, or in connection with, this Agreement shall be submitted to arbitration/mediation/negotiation (circle one) in accordance with, and subject to the laws of Commonwealth of Australia.
